Pinetown advocate may be struck off the roll

The Mercury reports that a Pinetown advocate faces being struck off the roll of advocates for accepting work directly from the public as opposed to being instructed by an attorney.

An application to strike off Edward Levin from the roll had been brought in the Pietermaritzburg High Court on Friday, 2 March 2012 but was adjourned to May 21 for oral evidence to be heard. Advocates' Society chairman Marumo Moerane said that Levin's entire manner and structure of practice were in contravention of fundamental principles in terms of which an advocate was expected to practise.

According to The Mercury, Levin, who practised from Mariannhill Park in Pinetown, was in contempt of a previous court order granted in January 2002, suspending his right to practise as an advocate, Moerane said. "He ignored his earlier suspension, persisted in the conduct which led to his earlier suspension and breached the rules of the advocates' practice and profession on a recurrent basis."

The Witness reports that Moerane alleged, in papers before the court, that Levin has "in a litany of instances" flouted the profession's rules, for example, by dealing directly with members of the public, appearing as an advocate in the absence of an instructing attorney, and performing the work ordinarily done by an attorney.
