Role descriptionThe candidate will be responsible for the following:- Ensuring compliance with all legal and compliance requirements applicable to the SACAP;
- Oversee all SACAP compliance initiatives, including corporate governance, POPIA, and PAIA;
- Conducting due diligence of all SACAP service providers;
- Drafting of legal contracts such as Service Level Agreement (SLAs), Employment contracts, Consultancy Agreements; Project Management Contracts.
- Ensure compliance with the Code of Conduct;
- Ensure effective handling of complaints of improper conduct, support the Investigating Committee, Disciplinary Tribunal and the Council;
- Review and maintain the code of conduct and the rules of Inquiry, and standard operating procedures (process, policy and procedures)
- Develop and maintain an investigation system (i.e. process, policies and procedures
- Develop and maintain an Investigation Practice (i.e., standards and rules)
- Manage Co-ordinate the activities of the Tribunals
- Manage the preparation and issuing of disciplinary charges of improper;
- Prepare and issue notices for penalties and fines
- Undertake legal research and benchmark studies
- Develop stakeholder advisory practice notice (and alerts) on issues related to Architectural Professional.
- Develop case studies, based on disciplinary hearings concluded, highlighting lessons learned and areas that require improvement;
- Lead special projects and programmes
- Manage Project resources (i.e. people, time and funds)
- Manage activities, performance and development of staff
- Manage the departmental budget
- Manage external service providers
- Prepare management reports
- Manage risks within the department;
- Understanding of quality management systems
Requirements:- Legal degree
- Postgraduate qualification (e.g. Corporate Governance /Compliance Management)
- Minimum of 5 years relevant work experience
- Added advantage-Admitted Attorney or Advocate
- Theoretical and / or practical background that can contribute to the overall effectiveness of SACAP in terms of its mandate Understanding of relevant policies and practice within the Regulatory framework;
- Strong analytical abilities;
- Excellent communication skills;
- Risk Management expertise;
- Ability to interpret complex legal guidelines; and
- Attention to detail
